These Terms govern access to simtoken.cc and the purchase and use of eSIM data plans offered through it. Please read them before creating an account, adding Token (TKN) credit or ordering a plan. The contracting provider is Tellavant Connect Ltd, a company registered in England and Wales. A plan is paid for using the TKN balance in the account; the eSIM profile is supplied digitally and provides mobile data only, subject to the plan description and the coverage and technical limits in these Terms.
1. About these Terms
1.1 These Terms and Conditions (Terms) form a legally binding agreement between you and Tellavant Connect Ltd (Tellavant, we, us or our) when you create or use an account on simtoken.cc (the Website), add TKN to your account, or order or use an eSIM data plan through the Website.
1.2 Tellavant Connect Ltd is registered in England and Wales under company number 17539371. Its registered office is 79 College Road, Harrow, HA1 1BD, United Kingdom. You can contact us at support@simtoken.cc.
1.3 The Website is an online storefront for travel eSIM data plans. Tellavant makes the Website and account balance available and arranges the digital delivery of eSIM profiles and plan information. Mobile connectivity is delivered using mobile networks and other infrastructure outside the Website itself. The available countries, networks, data allowances, validity periods, activation rules and other plan-specific details are shown with the relevant plan before you order.
1.4 These Terms apply together with the Privacy Policy made available on the Website. If a specific plan description expressly states a plan-specific rule that differs from these Terms, that rule applies to that plan only, to the extent permitted by law. Mandatory consumer rights always prevail over inconsistent wording in these Terms or a plan description.
2. Definitions
2.1 Account means your registered user account on the Website.
2.2 Balance means the amount of TKN recorded in your Account and available to pay for plans.
2.3 eSIM means a digital SIM profile that can be installed on a compatible device without a physical SIM card.
2.4 eSIM Profile or Profile means the digital credentials supplied for installation of a particular plan, including a QR code, manual installation details and related instructions where available.
2.5 Plan means a data-only eSIM package offered on the Website, identified by its data allowance, validity period, supported destination or coverage region and any other terms shown before purchase.
2.6 TKN means Token, the Website's internal account credit used to pay for Plans. One EUR corresponds to 10 TKN for Website pricing and account credit calculations, unless a mandatory legal requirement provides otherwise.
2.7 Payment Partner means the third-party payment service provider used to accept payments for adding TKN to an Account.
2.8 Consumer means an individual acting wholly or mainly outside their trade, business, craft or profession.
3. Acceptance and updates
3.1 By ticking the acceptance box during registration, creating an Account, adding TKN or ordering a Plan, you confirm that you have read and agree to these Terms. If you do not agree, do not create an Account or use the Website.
3.2 We may update these Terms to reflect changes in law, security requirements, the Website or our services. We will publish the updated version on the Website and change the “Last updated” date. A change will not retrospectively alter an order already accepted. If a change materially affects an existing Account or ongoing Plan, we will give reasonable notice where practicable. If you do not agree with a change, you may stop using the Website and ask Support to close your Account, subject to any outstanding order and applicable law.
3.3 The version of the Terms in effect when we accept an order governs that order, except where a later change is required by law or is expressly agreed with you.
4. Eligibility and registration
4.1 You must be at least 18 years old and legally capable of entering into a binding contract to register for and use the Website. The Website is not intended for use by anyone under 18.
4.2 To register using an email address, you must provide your name, a valid email address and a password, and confirm acceptance of these Terms and the Privacy Policy. You must verify your email address using the verification code sent to it before registration is complete. You may also register using a Google account. If you use Google sign-in, you authorise the relevant account information to be used for registration and sign-in as described in our Privacy Policy.
4.3 You must provide accurate, complete and current information and update it when it changes. You may not impersonate another person, use an email address without authority or create an Account for an unlawful purpose.
4.4 You are responsible for keeping your password and sign-in credentials confidential and for activity carried out through your Account. Contact Support promptly if you believe that someone has accessed your Account without permission. We may ask reasonable questions to verify your identity before changing account details, processing a balance request or disclosing account information.
4.5 Each Account is for the personal use of the person who registered it. You may not sell, rent, lend, sublicense or otherwise transfer an Account, its Balance or an eSIM Profile to another person. You may not create or operate Accounts on behalf of others without our written approval.
5. The Website and available service
5.1 The Website allows you to browse Plans, add TKN to your Balance, order a Plan and receive the corresponding eSIM Profile and installation instructions. Features and availability may change over time.
5.2 A Plan provides mobile data only. It does not include voice calls, SMS, a telephone number, or access to emergency services. Do not rely on a Plan to contact emergency services. Keep another means of communication available when travelling.
5.3 A Plan is limited to the destination, coverage area, network, data allowance, validity period, start or activation rules and other restrictions stated in its description. A country or region label does not promise that service will be available at every location within that territory, indoors, underground, on a particular transport route or through every local network.
5.4 Service quality and availability may vary with location, local network coverage, congestion, signal strength, terrain, buildings, weather, maintenance, roaming arrangements, device settings and other conditions. Actual speeds may be lower than advertised or may vary. We do not promise uninterrupted, continuous or minimum-speed connectivity unless a specific Plan description expressly says otherwise.
5.5 The Website and Plan catalog may be unavailable temporarily for maintenance, upgrades, security, operational or external network reasons. We may suspend or limit a feature where reasonably necessary to protect users, comply with law, address a security issue or maintain the Website. We will use reasonable efforts to restore affected features when practicable.
6. Plan information and ordering
6.1 Before ordering, review the Plan description carefully, including supported countries or regions, networks where stated, data allowance, validity period, activation conditions, compatibility information and price. The description presented at the time we accept your order forms part of the contract for that Plan.
6.2 Plans are paid for exclusively from the TKN Balance in your Account. You must have sufficient available TKN to complete an order. Selecting a Plan does not reserve it or create a contract until we accept the order and deduct the applicable TKN amount.
6.3 Your order is an offer to purchase the selected Plan. The order is accepted when we confirm that the Plan has been purchased and deduct the displayed TKN amount from your Balance. If we cannot accept an order, we will not deduct the Plan price or will restore any amount deducted for that order.
6.4 We may decline or cancel an order before supply where the Plan is unavailable, the order contains an obvious pricing or description error, the Balance is insufficient, we reasonably suspect unauthorised or unlawful use, or supply is prohibited by law. If we have already deducted TKN and do not supply the Plan, we will return the deducted TKN to your Balance or otherwise provide the remedy required by law.
6.5 An order is for the Plan and Profile stated in that order. Please check your intended destination, device compatibility and Plan requirements before purchase. We are not responsible for a purchase made for the wrong destination or device where the Plan was supplied as described, subject always to your statutory rights.
7. TKN Balance and top-ups
7.1 TKN is internal account credit used only to purchase Plans through the Website. The stated conversion is 1 EUR = 10 TKN. TKN does not earn interest, is not transferable between Accounts, cannot be sold or exchanged between users and may not be used outside the Website.
7.2 You may add TKN to your Balance as often as you choose. There is no daily or monthly top-up limit set by us. A top-up is not subject to an expiry date, and unused TKN does not lapse or expire while the Account remains open, subject to section 14 (Account closure and deletion) and applicable law.
7.3 The amount of TKN credited will correspond to the amount shown before you confirm the top-up. If a payment is declined, reversed, incomplete or not confirmed by the Payment Partner, the corresponding TKN may not be credited or may be withheld while the payment status is resolved. We will correct a confirmed technical error in the TKN amount.
7.4 TKN cannot be used to obtain cash except where a balance return is required or permitted under these Terms or applicable law. To ask for a return or withdrawal of an unused Balance, contact Support at support@simtoken.cc. We may ask you to confirm your identity, account ownership, top-up history and preferred lawful payment route. Any amount due for an unused Balance will be calculated using the stated conversion rate of 10 TKN per EUR, subject to the amount actually paid, applicable law and any required verification. We will process an approved balance return within 14 days after receiving your request and the information reasonably needed to process it. This does not reduce any shorter period required by law.
7.5 Once TKN has been applied to a Plan, it is spent for that order and is not an unused Balance. The Plan refund rules in section 10 apply to TKN spent on a Plan.
8. Prices, taxes and payment processing
8.1 Plan prices and top-up amounts are displayed on the Website in TKN and, where shown, their EUR equivalent using the rate in section 7.1. The price displayed when we accept your order is the price payable for that order.
8.2 The displayed price includes applicable taxes. The same Website price applies irrespective of the country from which you access the Website or the country in which you use the Plan, subject to any mandatory legal requirement.
8.3 TKN top-ups are paid through our Payment Partner. To initiate a top-up, the Website sends the Payment Partner only the billing details needed to process the transaction and the amount. The Payment Partner operates the payment page and handles payment credentials, card information, authentication such as 3-D Secure, payment verification and any payment-method refund. We do not receive or store your full card details or 3-D Secure credentials through the Website. Further information about personal data sharing is in the Privacy Policy.
8.4 Your payment transaction is subject to the Payment Partner's applicable terms and privacy information. We are not a party to the Payment Partner's separate payment services agreement. If you need help with a payment made for a top-up, contact Support first; we may coordinate with the Payment Partner where necessary.
8.5 A top-up is credited only after the Payment Partner confirms the payment. Processing times may vary. We are not responsible for delays caused by your bank, payment method, Payment Partner or a network outside our reasonable control, but we will take reasonable steps to investigate a reported missing or incorrect top-up.
9. Delivery, installation and activation
9.1 Following acceptance of an order, the Profile is provided digitally. Delivery may include a QR code, manual installation details and an installation guide. You are responsible for keeping the Profile and its installation details secure and private.
9.2 Follow the supplied installation instructions and the instructions provided by your device manufacturer. Installation generally requires an internet connection. The Profile may need to be installed before travel, while activation or validity may begin only when stated in the Plan description. Follow the specific Plan instructions because activation rules differ between Plans.
9.3 A Profile is intended to be installed on one compatible device and must not be transferred to another device after installation. A Profile may be single-use and may not be recoverable if deleted, reset, transferred, damaged or removed from the device. Do not delete a working Profile unless the instructions for the Plan say it can safely be reinstalled.
9.4 Before ordering, you must check that your device supports eSIM, is not carrier-locked or otherwise restricted from using another provider's eSIM, and supports the relevant network bands and settings. Device compatibility can vary by model, regional version, software version and carrier restrictions. We do not guarantee compatibility merely because a device supports eSIM in another context.
9.5 An order is treated as digitally delivered when the Profile and its instructions have been made available to you through your Account or another agreed delivery method. If the Profile is not made available, contact Support. We will investigate and apply section 10 if the Profile was not issued.
9.6 You must not disclose, publish or share a QR code or manual installation details. Anyone with access to them may be able to install or use the Profile. Tell Support promptly if you believe your Profile has been exposed or used without permission.
10. Cancellation, withdrawal and refunds
10.1 All cancellation, withdrawal and refund requests must be made by contacting Support at support@simtoken.cc. Please include your account email address, the relevant order or top-up details and a clear description of what you are requesting. We may ask for reasonable information to verify the request and investigate the issue.
10.2 Once a Plan has been ordered, its price is charged for the Plan for the full stated validity period. Except where these Terms or applicable law require otherwise, a Plan is non-refundable after it has been supplied. We do not provide a partial refund for unused days, partial use, unused data, exhausted data allowance, a Profile that you have not installed, or a device that is incompatible, carrier-locked or otherwise unable to use eSIM, where the Plan was supplied as described.
10.3 We will return the Plan price to your Balance in TKN in either of the following cases: (a) the eSIM Profile was not issued; or (b) the Plan did not work in the country stated for it and our Support team has confirmed that failure after reviewing the information reasonably available. A return under this section will be for the TKN amount charged for that Plan and will be credited within 14 days after we receive your request. This contractual remedy does not limit any additional remedy that cannot lawfully be excluded.
10.4 If you believe that a Plan did not work as described, contact Support as soon as reasonably possible and before the Plan expires where practicable. Provide the order reference, destination, device model and software version, installation and network settings, the time and location of the issue, and any troubleshooting details reasonably requested. We may ask you to follow reasonable diagnostic steps to distinguish a Plan or Profile issue from a device, setting, coverage or local network issue. We will assess the claim fairly and confirm whether the issue is supported by the available evidence.
10.5 A request to return unused TKN is handled under section 7.4. A request to return an unused Balance because you are deleting your Account is handled under section 14. A Plan refund under section 10.3 is made in TKN to your Balance unless applicable law requires a different remedy.
10.6 If you are a Consumer, you may have a statutory right to cancel a distance contract within a cooling-off period. For digital content supplied electronically, that right may be lost once supply begins if you have given the consent and acknowledgement required by law. Any statutory cancellation right and its conditions apply regardless of section 10.2. To exercise a right to cancel or ask how it applies to your order, contact Support within the applicable period. We will not treat this section as obtaining your consent to immediate supply or as your acknowledgement of losing a cancellation right; any consent or acknowledgement required by law must be obtained from you separately and expressly before supply begins.
10.7 Where a cash refund is due, we will arrange it without undue delay and within 14 days from the date of your request, or within any shorter period required by law. Where applicable law requires a refund to be made using the original payment method, we will follow that requirement and coordinate with the Payment Partner.
10.8 Refunds are not available for a reason that is expressly excluded above, except where mandatory law gives you a right to a refund or other remedy. Nothing in these Terms limits a Consumer's non-excludable rights in relation to digital content, services, unfair terms, or other statutory protections.
11. Using the eSIM and data allowance
11.1 You may use a Plan only for your own lawful, personal data connectivity in the stated coverage area, subject to the Plan's limits. You must comply with these Terms, applicable laws and the reasonable instructions associated with the Plan.
11.2 A Plan does not include voice services, SMS, a telephone number or emergency calling. If you need those services, arrange a separate mobile service. Do not rely on the eSIM for emergency communications.
11.3 When the Plan's data allowance is exhausted, mobile data under that Plan stops. To continue using mobile data, you must purchase another Plan. We do not promise that unused data will carry forward or that a Plan can be topped up unless the Plan description expressly provides this.
11.4 You must not resell, transfer, share, commercially exploit or otherwise make a Profile or Plan available to another person. You must not use the Website or a Plan to evade a legal restriction, commit fraud, interfere with a network, infringe another person's rights, distribute malware, send unlawful communications or disrupt services.
11.5 You must not copy, reverse engineer, alter, extract, decompile, circumvent or tamper with a Profile, the Website, or a security or access-control feature, except to the extent such restriction is prohibited by law. You must not use automated means to scrape the Website or interfere with its operation without our written permission.
11.6 You may not use a Plan in a manner that materially exceeds the ordinary personal use contemplated by the Plan, including through unlawful resale, commercial redistribution or deliberate circumvention of a Plan's stated technical restrictions.
12. Restrictions, suspension and account security
12.1 We may restrict, suspend or close an Account, cancel an unfulfilled order or disable access to a Profile where we reasonably believe that you have materially breached these Terms, the Account is compromised, the Profile or Balance is being transferred or resold, the Website is being misused, or action is reasonably necessary to comply with law, protect security or prevent harm to users or networks.
12.2 Where reasonably practicable, we will notify you of the reason and give you an opportunity to resolve a remediable issue before restricting the Account. We may act immediately without prior notice where necessary to address a security risk, suspected unlawful activity, a serious breach, or a legal or network requirement. You may contact Support to ask for a review.
12.3 A restriction does not remove your right to any TKN refund, unused Balance return or other remedy that is due under these Terms or applicable law. We may retain or withhold only amounts reasonably necessary to investigate a genuine dispute, comply with law or protect against a demonstrated risk, and will explain the basis to you where legally permitted.
12.4 We may discontinue or change a Plan or the Website prospectively. We will not use a change to remove a Plan already purchased during its stated validity period, except where continued supply is not reasonably possible or is prohibited by law or an applicable network requirement. In that case, we will provide an appropriate remedy required by law and, where appropriate, return the affected unused value.
13. Support and complaints
13.1 Support is available by email at support@simtoken.cc. Use this address for questions about the Website, an Account, an order, a Profile, a refund, a cancellation, a balance return, or account deletion.
13.2 Please provide enough detail for us to identify the issue. We aim to acknowledge and review support requests within a reasonable time. Response times may be longer during high-volume periods or where we need information from a Payment Partner or network provider.
13.3 A support request does not automatically mean that a refund or other remedy is approved. We will assess the request under the relevant Plan description, these Terms and applicable law, and explain our decision.
14. Account closure and deletion
14.1 You may request closure and deletion of your Account by contacting Support at support@simtoken.cc. Account deletion is not available through self-service tools. We may ask you to verify your identity and confirm the request before processing it.
14.2 When you request deletion, we will stop accepting new orders on the Account and will close the remaining TKN Balance. Any unused Balance that is refundable under applicable law or these Terms will be returned within 14 days from the date of your request, using a lawful refund method coordinated through the Payment Partner where needed. If we reasonably need additional information to verify the request or process the return, we will tell you promptly; this does not extend any mandatory statutory deadline.
14.3 An eSIM Profile already supplied for a paid Plan will remain available for use until the end of its stated validity period, subject to data allowance, Plan conditions, network availability and these Terms. Deleting an Account does not extend the Plan's validity period or replenish its data allowance.
14.4 We may retain information after Account deletion where necessary to meet legal, accounting, security, fraud-prevention or dispute-resolution obligations, or to establish or defend legal claims. Retained information will be handled in accordance with the Privacy Policy and applicable law. Deletion of the Account does not automatically erase records that we are legally required or permitted to retain.
14.5 Account deletion does not affect rights or obligations that accrued before deletion, including a pending refund or balance return request, nor provisions that by their nature continue after closure.
15. Privacy and personal information
15.1 Our Privacy Policy explains what personal data we collect, how we use it, the categories of recipients (including the Payment Partner), how long we retain it and the rights available to you. Please read it before using the Website.
15.2 We share with the Payment Partner only the billing details and amount needed to initiate a top-up. The Payment Partner handles the payment page, card and payment credentials, authentication, verification and payment-method refunds. More detail, including the applicable data-protection roles and your rights, is set out in the Privacy Policy.
15.3 You must not provide another person's personal information unless you are authorised to do so and have met any notice or consent requirements that apply.
16. Intellectual property
16.1 The Website and its text, design, software, branding, graphics and other materials are owned by or licensed to Tellavant or its licensors and are protected by intellectual-property laws.
16.2 We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Website and the Profile solely to purchase and use a Plan in accordance with these Terms. This licence does not transfer ownership of any intellectual property to you.
16.3 You may not use our name, logos or other branding in a way that suggests endorsement, affiliation or commercial partnership without our prior written consent.
16.4 Any feedback or suggestions you provide may be used by us to improve the Website without restriction, provided that this does not affect your ownership of any personal information or other rights under applicable law.
17. Third-party networks and external services
17.1 Some parts of the service depend on mobile network operators, roaming arrangements, device manufacturers, operating systems, internet access and the Payment Partner. These are separate services and may be subject to their own terms, coverage limitations and privacy information.
17.2 We are responsible for performing our obligations under these Terms. We do not exclude responsibility for acts or omissions of a person we engage to perform an obligation on our behalf to the extent that applicable law makes us responsible. We are not responsible for an independent network operator's or other third party's separate service to the extent the failure is outside our reasonable control and is not caused by our breach, negligence or failure to perform an obligation we have undertaken.
17.3 Links to third-party websites or services are provided for convenience. We do not control their content or terms. Your use of them is at your own discretion and may be subject to separate conditions.
18. Disclaimers and liability
18.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any Consumer right or remedy that cannot lawfully be excluded or limited.
18.2 If you are a Consumer, we are responsible for foreseeable loss and damage caused by our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, or for business losses where you use the Website as a Consumer.
18.3 If you use the Website for business purposes, to the fullest extent permitted by law we are not liable for indirect or consequential loss, loss of profits, revenue, business opportunity, goodwill or anticipated savings. Our total liability for all claims arising in connection with the relevant order or Website use will not exceed the higher of (a) the amount you paid to us for the relevant Plan or top-up in the 12 months before the event giving rise to the claim; and (b) EUR 100. This limit does not apply to liability that cannot lawfully be limited.
18.4 We are not responsible for a failure or delay caused by an event beyond our reasonable control, such as a widespread network outage, natural event, war, civil emergency, government action, interruption to electricity or telecommunications, or failure of essential infrastructure. We will take reasonable steps to reduce the effect and resume performance. If the event prevents a Plan from being provided, your statutory rights and the refund provisions in these Terms remain unaffected.
18.5 You are responsible for losses we reasonably incur as a direct result of your deliberate or fraudulent misuse of the Website or material breach of these Terms, except to the extent the loss was caused by our own act or omission. This section does not require you to indemnify us for losses that applicable law does not permit us to recover from you.
18.6 The Website is provided for personal travel connectivity planning and use. It is not a substitute for reliable emergency communications, a dedicated business-critical connection or professional advice about local telecommunications availability.
19. Governing law and disputes
19.1 These Terms and any non-contractual obligations arising out of or in connection with them are governed by the law of England and Wales, except that if you are a Consumer resident in another country, you may also benefit from mandatory protections of the law of your country of residence that cannot be excluded by agreement.
19.2 The courts of England and Wales have jurisdiction over disputes arising from these Terms, subject to any mandatory rule that allows a Consumer to bring proceedings in their country of residence or requires proceedings to be brought elsewhere.
19.3 Before starting court proceedings, please contact Support and explain the issue. We will try to resolve it through the support process. This does not limit any right to bring a claim or any applicable time limit.
20. General terms
20.1 If a court or competent authority finds part of these Terms invalid or unenforceable, the rest will remain effective. The affected part will be interpreted or adjusted only to the minimum extent needed to make it enforceable where permitted by law.
20.2 You may not assign, transfer or delegate your rights or obligations under these Terms without our prior written consent. We may transfer our rights and obligations to a successor or group company as part of a genuine business reorganisation or transfer, provided that doing so does not reduce your rights under these Terms or applicable law.
20.3 These Terms, the applicable Plan description and the Privacy Policy contain the agreement between you and us concerning use of the Website and the relevant Plan, except for any separate terms that apply to the Payment Partner's payment services.
20.4 A failure or delay by us to enforce a right is not a waiver of that right. A waiver is effective only if made in writing and applies only to the specific circumstances for which it is given.
20.5 Nothing in these Terms creates a partnership, agency, employment or joint venture relationship between you and Tellavant.
20.6 These Terms are written in English. If they are translated, the English version prevails to the extent permitted by law in case of inconsistency.
20.7 Notices and requests under these Terms must be sent to support@simtoken.cc, unless a different method is required by law. We may send account-related notices to the email address associated with your Account or make them available through the Website.
